Terms & Conditions

Terms for accounts, ordering, payment, delivery and purchases from Big Power Parts.

On this page

Effective date: 9 September 2026

These Terms and Conditions apply to your use of https://bigpowerparts.com.au and to orders placed with Big Power Parts, operated by ML GROUP BUSINESS PTY LTD (ABN 52 669 512 449) ("Big Power Parts", "we", "us" or "our").

Please read these Terms and Conditions before creating an account or placing an order. By creating an account or placing an order after being shown these terms, you agree to the terms applicable to that account or purchase.

Contact details:

1. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Where we are permitted by law to limit our liability, we limit our liability to the fullest extent permitted.

2. Eligibility and accounts

You may create an account or place an order only if you are at least 18 years old, or if you have permission from a parent, guardian or authorised business representative.

You are responsible for:

  • providing accurate, current and complete account, billing and delivery details
  • keeping your login details secure
  • activity you authorise under your account and taking reasonable steps to prevent unauthorised access
  • notifying us promptly if your account details change or if you suspect unauthorised access.

We may refuse, suspend or close an account where we reasonably believe the account has been used fraudulently, unlawfully, in breach of these Terms and Conditions, or in a way that may harm us, our customers, suppliers or website.

3. Website use

You must not:

  • use the website for unlawful, fraudulent or misleading activity
  • impersonate another person or use another person's account without permission
  • interfere with website security, availability or performance
  • introduce viruses, malware, scraping tools, bots or automated purchasing tools
  • copy, reproduce, scrape or commercially exploit website content without our written permission
  • submit false, abusive, defamatory or harmful content.

4. Product information and fitment

We sell machinery, equipment, vehicle and replacement parts, including new, used and reconditioned products. Product descriptions, images, part numbers, compatibility information, condition descriptions, warranty information and availability are provided in good faith, but may be incomplete, approximate or subject to manufacturer or supplier changes.

You are responsible for checking that a product is suitable for your intended machine, vehicle, equipment, model, serial number, application and use before purchasing. If you are unsure, you should contact us before ordering and provide all relevant model, serial number, part number and fitment information.

Any reference to original equipment manufacturer names, brands, models or part numbers is for identification and compatibility purposes only unless we expressly state that a product is genuine OEM. Aftermarket products are not represented as being manufactured, endorsed or approved by the original equipment manufacturer unless expressly stated.

Please obtain written fitment confirmation where possible. This does not exclude consumer guarantees arising when you tell us your intended purpose and reasonably rely on our advice, whether given verbally or in writing.

5. Product condition

We classify products as new, used, reconditioned, refurbished, rebuilt, repaired, damaged, clearance or another condition category based on the information available to us, including supplier information, inspection, testing, repair history, product age, packaging and appearance. The relevant product page or pre-sale description explains the condition, known defects and work carried out. Condition labels do not override the product description or consumer guarantees.

Unless we state otherwise:

  • new products are unused products supplied as new, although packaging may show ordinary storage or handling marks
  • used products are previously owned or previously fitted products that may show wear, marks, ageing or previous use
  • reconditioned products are used products that have been cleaned, inspected, repaired, rebuilt, tested or otherwise prepared for resale to the standard we consider appropriate for that product.

Used and reconditioned products may have different warranty periods and may not have the same appearance, packaging, accessories, service life or warranty coverage as new products. You should read the product details carefully before ordering.

6. Technical information, installation and maintenance

Information on our website or provided by our staff is general product information and is not a substitute for professional mechanical, electrical, engineering, safety or compliance advice.

Products must be installed, operated and maintained correctly and, where appropriate, by a suitably qualified person. You are responsible for complying with all laws, safety requirements, manufacturer instructions, service schedules, fluid, filtration, lubrication, cooling, calibration and equipment requirements that apply to installation, operation, maintenance and use.

A claim may be declined to the extent the problem was caused by incorrect installation, operation, misuse, modification, lack of maintenance, unsafe use, contamination, overheating, overloading or failure to follow instructions. An unrelated installation or maintenance issue does not remove your consumer guarantee rights.

7. Orders

An order placed through the website is an offer by you to purchase the products in that order. Before acceptance, we may reasonably reject an order where:

  • a product is unavailable
  • there is an error in price, description, image, shipping cost or availability
  • payment is not authorised or is reversed
  • we suspect fraud, unauthorised resale, misuse or unlawful activity
  • delivery cannot reasonably be made to the address provided
  • a supplier or manufacturer discontinues or changes a product.

An order is accepted when we confirm acceptance or dispatch the product, whichever occurs first. Automated order acknowledgements confirm receipt of your order but do not guarantee acceptance.

8. Prices, GST and payment

Prices are in Australian dollars. Any separately identified GST, delivery charges and other applicable charges are shown in the order summary before you place the order or pay. Nothing in these terms permits us to omit GST or unavoidable charges from consumer price displays where the law requires their inclusion.

If we discover a pricing or listing error before accepting an order, we will explain it and offer you the choice of proceeding at the corrected price or receiving a full refund. We will not charge an increased amount without your agreement. Price changes do not alter an accepted order.

You must pay all amounts due at the time and in the manner required by checkout or invoice. We may withhold dispatch until payment has cleared.

9. Availability, backorders and special orders

Stock availability may change without notice. Products may be supplied from our own stock, suppliers, manufacturers or third-party warehouses.

If a product is unavailable, delayed, discontinued or subject to supplier change, we will contact you about a backorder, partial shipment, refund or cancellation. We will obtain your agreement before substituting a different product or charging extra.

Products sourced or prepared specifically for you may not be cancellable or returnable for change of mind once committed to a supplier or prepared for you, unless we approve the cancellation or return or the law requires it. For approved change-of-mind cancellations or returns, a restocking fee applies only to pre-order or non-stock products ordered specifically for you from a local or overseas manufacturer or supplier, as explained in our Returns & Refunds Policy. The fee is limited to the lower of 20% of the affected product’s price paid (including GST, excluding separately charged freight) and our reasonable, documented cancellation or restocking costs actually incurred, without recovering the same cost twice. The calculation must be disclosed before purchase and the fee confirmed before you proceed. No restocking fee applies to products supplied from our own stock or to remedies required under the Australian Consumer Law.

10. Delivery and risk

Delivery timeframes are estimates only and may be affected by freight networks, supplier delays, customs, weather, public holidays, remote delivery locations, bulky goods handling, dangerous goods requirements or other circumstances outside our control.

Risk in the products passes to you when the products are delivered to the delivery address, collected by you, or collected by your nominated carrier or representative. If you authorise unattended delivery, we must still deliver to the agreed address and follow your delivery instructions. A carrier scan alone does not remove your right to dispute non-delivery. Nothing in this section limits our responsibility under the Australian Consumer Law.

You must inspect deliveries promptly and notify us as soon as possible if an item is missing, damaged in transit, incorrect or incomplete.

11. Title

Ownership of products passes to you only when we have received full cleared payment for the products and all related charges.

12. Cancellations

You may request cancellation before dispatch, but cancellation is not guaranteed. For change-of-mind requests, we may refuse cancellation where an order has been dispatched, packed, specially ordered, customised, imported, modified, programmed, or otherwise committed to a supplier. This does not limit any right to cancel or receive a refund under the Australian Consumer Law.

We may cancel an order on the reasonable grounds described in section 7, subject to your legal rights and any binding acceptance. If we cancel after payment, we will refund the cancelled products and any delivery charges attributable to them. We will not deduct unrelated debts from that refund.

13. Returns, refunds and warranty

Returns and refunds are handled under our Returns & Refunds Policy. Warranty claims are handled under our Warranty Policy. Those policies and our Shipping & Delivery Policy form part of these Terms and Conditions.

Voluntary warranty periods are set per product and stated on the product page before purchase, or confirmed in writing before a direct order. We will honour the warranty represented at purchase. If we identify an error before accepting your order, we will explain it and offer a full refund if you do not agree to the corrected terms. Later communications cannot unilaterally reduce a warranty already promised.

Your rights under those policies are in addition to any rights you have under the Australian Consumer Law.

14. Promotions, discounts and credits

Promotions, discount codes, coupons, store credits and gift cards may be subject to additional terms, expiry dates, exclusions and minimum spend requirements. Unless stated otherwise, they are not redeemable for cash and cannot be combined with other offers.

If an order is refunded or cancelled, any related discount, store credit, loyalty benefit or promotional value may be reversed or adjusted.

15. Business customers

If you purchase products for business, trade, commercial or resale purposes, you acknowledge that:

  • you are responsible for checking suitability for the intended application
  • downtime, labour, towing, hire equipment, loss of production, loss of profit and similar business losses may not be recoverable from us except to the extent required by law
  • to the extent permitted by law, our liability is limited to replacement, repair, resupply, refund, or the cost of replacement, repair or resupply.

16. Liability

To the extent permitted by law, we are not liable for indirect, special or consequential loss, loss of profit, loss of revenue, loss of production, loss of data, loss of opportunity, equipment downtime, labour costs, removal or installation costs, or third-party claims arising from use of the website, products, delivery delays, incorrect product selection, installation or use.

This clause does not limit the product remedies, freight or assessment costs we expressly agree to provide under our Warranty Policy or Returns & Refunds Policy, or any liability that cannot lawfully be limited, including under the Australian Consumer Law.

17. Intellectual property

All website content, including text, images, graphics, logos, product data, layout and design, is owned by us or licensed to us. You may use the website for personal or internal business purchasing purposes only. You must not copy, reproduce, distribute, scrape, adapt or commercially exploit website content without our written permission.

18. Privacy

We handle personal information in accordance with our Privacy Policy. The Privacy Policy explains our information handling practices. It is not a request for blanket consent to marketing or unrelated uses of your information; we seek separate consent where required.

19. Force majeure

Events beyond our reasonable control may delay performance. We will take reasonable steps to reduce the impact and keep you informed. This does not remove your rights to cancellation, a refund or another remedy where required by law, including where we cannot supply within a reasonable time.

20. Changes to these Terms and Conditions

We may update these Terms and Conditions from time to time. The version published on our website at the time you place an order will apply to that order. Continued use of the website after changes are published means you accept the updated terms for future use and orders.

21. Governing law

These Terms and Conditions are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of that State or Territory and the courts that hear appeals from them.
